Unless specifically stated by you in writing, we shall treat any information you provide us with, as non-proprietary and non-confidential. By accessing, downloading or using the products and/or services offered by Shira Psychic Medium™, Ltd. / Shira Psychic Intelligence®, whether registered or not as a member or by purchasing tickets to attend any of our events, you agree to be bound by these terms and policy, which you acknowledge that you have fully read and understood. If you object to the Terms of Purchase and/or Refund Policy, your only remedy is to immediately discontinue usage of our products/services.

In the event that you determine that your purchase was not the correct decision, contact us via email (as referenced above), and submit all of the course work and homework that you completed. We will review it and attempt to help correct the issue you are experiencing because we would like to see you succeed. Your eligibility for a full refund for the course is contingent upon your submittal request inclusive of your completed course classwork and homework for the entire 30 days of your participation before 23:59 hours Eastern Standard Time on the 30th day of your purchase. After submission of your completed course materials, all refunds are discretionary. We will not honor refunds to consumers who purchased training material and did not fully complete the system to the best of their abilities. We reserve the right to deny your refund request. If we deem it apparent (and we are psychic), that your classwork and homework is incomplete and that you did not implement the program strategies as laid out in the course, your refund will be denied. This policy is designed to see you advance in your study and commitment to higher consciousness advancement. It was not created to allow consumers to infringe upon the copyrights and intellectual property of Shira Psychic Medium™, Ltd. a/ts Shira Psychic Intelligence®. Any violation in the form of infringement will be subject to legal ramifications.  

Where we offer you a free trial of Shira Psychic Intelligence® Inner Circle or related memberships/services, such free trial will start immediately after your registration and continue for the free trial offer period as indicated on the Website at the time you register. Free trial subscriptions are only available to new subscribers of Shira Psychic Intelligence® and for the limited periods as set out on the Website. Previous subscribers or those subscribers who have already benefited from a free trial subscription to Shira Psychic Intelligence® do not qualify for a further free trial period. If you do not want to continue your subscription after your free trial comes to an end, you must contact us at least 24 hours before your free trial period ends by submitting a cancellation request to us via our support email address support@shirapsychicintelligence.com If you do not contact us at least 24 hours before your free trial period ends to cancel, your subscription will automatically continue and the payment card that you provided at the time of enrolment online will be charged the full Shira Psychic Intelligence® monthly membership subscription rate provided at the time of enrollment each month until you cancel. Shira Psychic Intelligence® can change the monthly membership subscription rate at any time. If the membership subscription rate changes after you subscribe, we will notify you by e-mail and give you an opportunity to cancel. If you wish to cancel your subscription at any time after a free trial or discounted period ends, you must submit a cancellation request to us via our support email address at support@shirapsychicintelligence.com For monthly subscriptions, we require at least ten (10) days’ notice of cancellation by e-mail. If you provide such notice less than ten (10) days before the first day of your next subscription month, your credit card will still be charged. You will not be entitled to pro-rate your last month’s use, nor will you be entitled to any refund for any payments to Shira Psychic Intelligence®. 

SECTION 3: SUBSCRIPTION TERMS AND AUTOMATIC PAYMENT AND CANCELLATION POLICY   

A Shira Psychic Intelligence® user is responsible for paying all sums due to Shira Psychic Intelligence® in connection with their monthly subscription in accordance with these Terms. The first fee payable in accordance with these Terms is due when the user account is set up and payment of the monthly fee is a condition of access, or after your free trial ends and you have not canceled the automatic subscription with us. Every calendar month, your account will be charged the subscription fee plus applicable tax for the following month’s subscription, together with any other fees for the following month’s subscription plus any accumulated charges for the past period (collectively, “Fees”). The Shira Psychic Intelligence® Inner Circle Membership and VIP Coaching Programs are subscription based.  Payment for these programs is collected before entrance into these programs are allowed.  These programs are not eligible for the 30 day refund policy.   Failure by the Shira Psychic Intelligence® user to use any of the services available through the service provided by Shira Psychic Intelligence® does not relieve the Shira Psychic Intelligence® user of their payment obligations under these Terms. Potential users can pay by credit card or debit card. Payment details shall be collected by us through our secure financial data collection mechanism. You acknowledge and agree that we hold data relating to the transaction, including the last four digits and the expiration date of the card used to purchase the products or services together with details on when payment is due. You further acknowledge and agree that payments are due on a recurring basis in accordance with the payment terms for the specific service purchased (unless the subscription is canceled in accordance with these Terms) and therefore authorize the automatic payment collection terms applicable to that specific service (e.g., on a monthly basis and for a specific amount). If you are a Shira Psychic Intelligence® user with a monthly subscription and you have provided us with a valid credit or debit card number or an alternate payment method, each payment will be automatically processed at the time of your designated payment date (Monthly) and will be billed to the payment method you provided us at the time of your enrollment. Services and Memberships are paid for in advance and/or on a monthly basis. Under no circumstances will you be entitled to a refund of any fees paid for any reason whatsoever if you have not complied with our cancellation policy. If you wish to cancel your subscription to Shira Psychic Intelligence® services and/or memberships, you may do so by emailing: support@shirapsychicintelligence.com at least thirty (30) days before the first day of your next subscription month. Shira Psychic Intelligence® reserves the right to immediately terminate a user’s account and/or service for any unpaid (in whole or part) period of the subscription (with or without notice). Termination of service in no way relieves or excuses the User from any obligation to pay outstanding charges or expenses. In the event Shira Psychic Intelligence® starts collection processes of any type, you will be liable for all collection costs, including legal and bank fees and expenses, as stated in Section 4. To the extent permitted by law, irrespective of whether you are absent or withdraw from the Services prior to the expiration of the duration, refunds are not provided for services, including where you have been given access to our content, whether accessed by you or not. You acknowledge and agree that you waive all rights to attempt to charge-back any amounts paid under this agreement with your credit card/debit card provider. In addition to any Fees, Shira Psychic Intelligence® may also charge applicable value added or other tax. 

Pricing or Typographical Errors

We do our best to provide accurate product and pricing information. However, pricing or typographical errors do occur. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. If an item is incorrectly priced, we will either contact you for instructions or cancel your order and notify you of such cancellation. Prices and availability are subject to change without notice.

Order Acceptance

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. For your convenience, you will not be charged until your payment method is authorized, the order information is verified for accuracy and your order is shipped. Some situations that may result in your order being canceled include limitations on quantities available for purchase; inaccuracies or errors in product or pricing information; or problems identified by our credit and fraud avoidance group. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card has been charged, we will issue a credit to your credit card in the amount of the charge.

Payments

You represent and warrant that if you are purchasing something from us that (i) any credit card information you supply is true, correct and complete, (i) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any shipping fees and applicable taxes.

Return Policy

Due to the nature of our online website, and the products/services listed, we have a strict NO RETURN policy for any digital product or service. No digital product or service shall be able to be returned for a like item, or for a cash refund.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Shira Psychic Medium, Ltd. a/ts Shira Psychic Intelligence®, its directors, officers, employees, shareholders, trustees, licensors, independent contractors, subcontractors, suppliers, affiliates, parent companies, subsidiaries, successors and agents from and against any and all claims, actions, loss, liabilities, damages, expenses, demands, and costs of any kind, including, but not limited to attorneys’ fees and costs of any litigation or other dispute resolution, arising out of, resulting from, or in any way connected with or related to (1) your use, misuse, or attempt to use the Website, software, products, or services, (2) information you submit or transmit through the Website or affiliated membership websites and their boards/ portals/interfaces, (3) your breach of these Terms, the documents they incorporate by reference, the Agreement, or the representations and warranties provided by you in this Agreement, or (4) your violation of any law or the rights of a third-party.  

These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the [COMPANY] (“Provider”) website located at the domain name of Shira Psychic Intelligence / Shira Psychic Medium, Ltd.  (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. By using our Platform in any manner you are expressly agreeing to, and give your consent to be governed by, these Terms. Electronic Communications 

By using this Website or communicating with the Provider by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing. 

E-Commerce & Privacy 

The Website sells Psychic Mediumship, Meditation & Motivational support courses and membership platforms online. The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.   The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product. Credit card details are not kept by the Provider under any circumstances. The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device. The Provider will supply all goods to the delivery company in good order. The Provider will not be held liable for the condition of goods arriving at the User’s chosen delivery address. 

Online Payment – Stripe Payment Gateway 

All online credit card payments are processed by the Stripe Internet Payment Gateway. Card Holders may go to https://stripe.com/privacy to view Stripes' security policies. 

The Provider reserves the right to cancel an order for which payment has already been received. Should the Provider exercise this right, the User will receive a full refund with no deductions. 

Updating of these Terms and Conditions 

Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

The User may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. Provider uses this information to determine use of the Website, and to improve Content thereon. Choice of Law

Course Access / Deletion

Should a course, or subscription account, or Student account be canceled or deleted, the Student may no longer have access to Content and Content may be irrecoverable. Shira Psychic Intelligence® / Shira Psychic Medium, Ltd. shall not be liable to any party in any way for the inability to access Content arising from any cancelation or deletion, including any claims of interference with business or contractual relations.  As a user of the service, user is only guaranteed access to service for the duration of the course offering.

No Guarantee

The parties hereto acknowledge and agree that Shira Psychic Intelligence® / Shira Psychic Medium, Ltd cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Company will use its best efforts and does not promise results of any sorts; the user agrees and understands this.

You acknowledge and understand that the Company and its Representatives are not medical professionals or other licensed professionals and that they do not diagnose medical conditions, prescribe medication or provide medical treatments. The Services provided by the Company and its Representatives will not, and is not intended to, replace professional medical diagnosis, treatment or advice or cure for any medical disease, condition or illness and is not intended to, nor should it take the place of, professional services, including, without limitation, medical, legal, financial, business or psychological services.

3. You acknowledge and understand that the Services offered by the Company and its Representatives are for educational, spiritual, entertainment and amusement purposes only, and you accept full responsibility for your own medical, health, mental, emotional, psychological, spiritual and bodily welfare. You acknowledge that you will decide what to do with the information given to you and any action you take, or inaction on your part, is your own personal responsibility and choice.  You acknowledge that by participating in services / coursework offered, that you are not guaranteed results. 

4. You acknowledge and understand that we cannot guarantee with whom the Representatives or User can or will be able to connect with and the Services are not guaranteed to be accurate, are subject to your own interpretation and that the psychic medium readings are not guaranteed to be applicable to you whether such reading is performed in a group setting or otherwise. In addition, your attendance in a group setting or individual session or meditation or class service does not guarantee you a reading.

5. You agree on behalf of yourself, your heirs, executors, administrators, successors and assigns, to fully release and discharge Shira Benedetto, the Company and its Representatives from all actions, causes of action, claims, liabilities, obligations, expenses and demands whatsoever, in law or equity, which you may have arising from, related to or based on any injuries, damages or losses to yourself or other persons, property, income or other matter which may be sustained, directly or indirectly, from or as a result of the Services. The Company and its representatives will not be liable for any damages resulting from the Services, or for any events related thereto, and/or any actions or decisions that you may make as a result of such Services, including, without limitation, actual, incidental, and/or consequential damages resulting from any claims resulting from any act or omission, negligence, misrepresentation or otherwise, nor for any personal injury, death, loss of income, stress (emotional or otherwise), errors or omissions, or otherwise.

6. Services are paid for in advance. Under no circumstance will you be entitled to a refund of any fees paid for any reason whatsoever.

7. You acknowledge and agree that no legally recognized privilege exists between you and Company and its Representatives the way a privilege might exist between an attorney and client, doctor and patient, husband and wife, or priest and penitent. While the Company exercises reasonable diligence in maintaining the confidentiality of your sessions, Company will have no liability to you for any disclosure of personal information.

8. You hereby consent to photography, audio recording or videotaping of any sessions during which the Services of Company are provided, and consent to its/their release, publication, exhibition or reproduction for public relations, news articles or telecasts, education, advertising, research, inclusion on Company’s website or any other purpose by the Company. You hereby waive all rights and claims for payment or royalties in connection with any exhibition or other publication of these materials, regardless of the purpose, and waive any right to inspect or approve any photo, video or audio recording in connection with any display or publication. Personal audio recording by you or any other participant of any session is strictly prohibited. Violation of this policy may result in the immediate termination of a session with no refund of fees paid or due.

9. All rights in the Services, copyright or otherwise, are hereby reserved by Company.

10. Any claims made against the Company and the Representatives are required to be asserted by commencement of an action within ninety (90) days after the date of the Services alleged to be the basis of any such claim or such claim shall be deemed waived and released forever.

11. In the event of litigation brought against the Company or the Representatives in connection with the Services, the Company, and the Representatives shall be entitled to an award of its reasonable attorneys’ fees and costs if they prevail in such proceeding.

I have carefully read this Participation Agreement and fully understand its content. I am aware that this agreement contains waivers and releases of personal liability. I understand that this agreement is binding and acknowledge that: (i) I am over the age of eighteen (18) and legally competent to execute this agreement; (ii) I am consenting to this electronically by continuing with the booking and that I agree to the agreement of my own free will; and (iii) for legal reasons, I have been advised that the exhibition I am participating in is for entertainment and amusement purposes only.

Hold Harmless

By requesting a reading and/or scheduling an appointment or attending developmental classes/membership services with Shira Psychic Medium / Shira Psychic Intelligence®, you understand and are agree that Shira Psychic Medium, Ltd. / Shira Psychic Intelligence is not a medical professional, attorney, accountant or other licensed professional, and can not give medical, legal, or tax advice. Any information or advice given by Shira Psychic Medium is not to be used by you in place of any medical, legal, tax or financial advice or diagnosis from qualified and licensed professionals in those fields. Readings by Shira Psychic Medium, Ltd. / Shira Psychic Intelligence are intended to offer insight into your personal life and do not in any way constitute medical, legal, tax, or financial advice. Shira Psychic Medium, Ltd. / Shira Psychic Intelligence will not be held liable for any damages resulting from any reading, class, instruction, energy healing or appointment with Shira Psychic Medium, or any persons or events related thereto, and/or any actions or decisions that you may make as a result, including without limitation, actual, incidental and/or consequential damages resulting from any claims resulting from any act or omission, negligence, fraudulent misrepresentation or otherwise, including without limitation, personal injury, death, loss of income, stress (emotional or otherwise), errors or omissions, or otherwise. Furthermore, the Receiving Party agrees to hold Shira Psychic Medium, Ltd. / Shira Psychic Intelligence and its officers, employees, and agents free harmless from and against any and all losses, penalties, damages, settlements, costs, charges, professional fees, or other expenses or liabilities of every kind and character arising out of or relating to any and all claims, liens, demands, obligations, actions, proceedings or causes of action of every kind and character in connection with or arising directly or indirectly out of this agreement and/or the performance hereof.
